TERMS OF USE
This agreement governs the legal relations arising between the company INTERNET-DMS S.R.L. (IDNO 1005600052331) hereinafter referred to as the “COMPANY” and the User of the site www.cigars.md in the process of using the specified site.

1. GENERAL PROVISIONS

1.1. Terms and definitions used:
Website – a number of logically interconnected web pages available on the Internet under the common domain name www.tabak.md;
Site user (user) is any economic agent (enterprise, individual entrepreneur), who, in accordance with Part 2 of Article 21 of the Law of the Republic of Moldova “On Tobacco Control” No. 278 of December 14, 2007. is a manufacturer, importer and/or seller of tobacco, tobacco products, similar products, devices and accessories for their use, refilling or heating, or its representative, who has reached the age of 18, has visited the site and/or completed the registration procedure on the site;
Personal data – any information related to an identified or identifiable natural person;
Content – information posted on the site that can be viewed or accessed using electronic equipment.
Account – a section of the site consisting of an email address and password, which allows the Site User to submit an order and which contains information about him and his history on the site (these may be, but are not clearly limited to, orders, guarantees, shopping lists, etc. ).
Order is an electronic document by means of which the Site User conveys to the Company through the site the intention to order delivery of goods from the store and through which a form of communication between the Company and the User is allowed.
Store – a store owned by the Company (not classified as an “online store”).
Delivery is a service provided by the Company to the Website User for the delivery of goods purchased by him in the store;
Personal data subject is any natural person who can be identified directly or indirectly by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity;
Processing of personal data is any operation or set of operations performed on personal data by automated or non-automated means, such as collection, registration, organization, storage, retention, recovery, adaptation or modification, retrieval, consultation, use, disclosure by transmission, distribution or in any other way, joining or combining, blocking, deleting or destroying;
Personal data accounting system – any structured set of personal data available in accordance with certain criteria, whether centralized, decentralized or distributed according to functional or geographical criteria;
A cookie is a small piece of data (text file) sent by the Company’s server to the Website User’s browser and stored on the User’s device (tablet, computer, etc.).

1.2. The site is intended exclusively for the use of business entities (represented by their representatives – individuals who have reached the age of 18), who, in accordance with Part 2 of Article 21 of the Law of the Republic of Moldova “On Tobacco Control” No. 278 of December 14, 2007. are manufacturers, importers and sellers of tobacco, tobacco products, similar products, devices and accessories for their use, refilling or heating. Persons who do not meet the requirements specified in this paragraph are prohibited from visiting the site and viewing its content.

1.3. This agreement contains the terms of use of the site and the conditions for the provision of services for the delivery of goods and the ensuing rights and obligations of the parties.

1.4. Filling out the form and registering on the site can be carried out by any person who meets the requirements specified in clause 1.2. present agreement.

1.5. Any person entering the site must reliably and under personal responsibility confirm his age by pressing the “Yes, I am over 18 years old” button located on the title page of the site, as well as first read the text of this agreement.

1.6. If a person under the age of 18 has intentionally or mistakenly gained access to the content of the site, he is obliged to leave it immediately. Control over compliance with the conditions provided for in this paragraph rests with the legal representatives of the minor and/or the minor’s employer.

1.7. By placing an order on the site, the user directly and explicitly agrees to the form of communication (by telephone or email) through which the Company carries out its operations, and cannot later refer to any circumstances that limit the possibility of using this form of communication.

1.8. This agreement comes into force from the day the Site User familiarizes himself with their

content. Familiarization with the contents of the User Agreement is considered completed from the moment you enter the site.

1.9. The user is obliged to familiarize himself with the updated text of the User Agreement each time he visits the site.

2. PROTECTION OF PERSONAL DATA. PRIVACY POLICY.

2.1. Company “Internet-DMS” S.R.L. registered in the register of personal data operators and was authorized by the National Center for Personal Data Protection to process the personal data of its clients, including site users.

2.2. Providing the Company by the Website User with his personal data (orally (in person, by phone), or the data is registered by the User in the system through the website’s web interface) is carried out voluntarily, thereby expressing his consent to the Company’s collection and processing of his personal data for the purposes provided for this user agreement (a separate agreement is not required).

2.3. The collection and processing of personal data is carried out within the framework of the Company’s personal data accounting system (database) for the purposes of:

• keeping records of users who have used the services or intend to use the Company’s services;

• providing support to site users;

• carrying out actions necessary for concluding civil contracts, creating a user account on the site, placing an order;

• fulfillment of other obligations arising from the legal relationship established with the user of the site.

2.4. The Company collects the following categories of personal data: name, date of birth, address of location (residence) of the User and/or delivery address, telephone number, email address, as well as other data provided by the User on his own initiative.

2.5. The company may disclose personal data:

• persons authorized by the Company;

• the subject of personal data (Site User) or his legal representative;

• supervisory authorities at their request, courts and other institutions authorized by law to request information;

• depending on the circumstances, debt collection companies, lawyers;

• the IT service provider providing the functionality of the site;

• courier services (solely for the purpose of fulfilling orders for the delivery of goods);

• payment processor.

2.6. The Company will make every effort to ensure that any confidential information relating to Site Users and relationships with them remains confidential. The transmitted information will be treated as confidential and will be used only for the purpose for which it was transmitted and will not be used for other purposes without the consent of the User, except as provided for by current legislation and this agreement.

COOKIES

2.7. When visiting the site, the Company places on the User’s device and processes the following types of cookies: session cookies and for the XSRF token. Session files are temporary files that remain on the User’s device until the end of the session or until the application (web browser) is closed.

2.8. At the end of the Internet session, session cookies are automatically deleted.
